Welcome! These Terms of Service (the “Terms”) set out the rules for using the games, websites, tools and services offered by IDFire Technologies Inc. (“IDFire”, “we”, “us” or “our”) and its affiliates, including our game studio Rad Games and our engine business Janus Engine.
A note for younger players: if you are under 18 (or under the age of majority where you live), please read these Terms with a parent or guardian before you play or create. If you are a parent or guardian accepting these Terms for a child, you accept them for yourself and for that child, and you are responsible for the child’s use of the Services.
By creating an account, playing our games or using our websites and tools, you agree to these Terms, including the limits on our liability, the rules for virtual items and credits, and the dispute-resolution terms in Section 20. If you do not agree, please do not use the Services.
- These Terms cover our games, radgames.ai, janusengine.com, Janus Studio, the Arcade and the Janus API and MCP server.
- Our games and digital items are licensed to you, not sold. Credits and in-game currencies have no cash value.
- Play fair and follow the Community Rules. Serious or repeated violations can cost you your account.
- You keep ownership of what you create. You give us the permissions we need to host and show it.
- If something goes wrong, contact us first. Most US disputes go to individual arbitration, and you can opt out within 30 days.
This summary is for convenience. The full text below is what governs.
1.Services covered by these Terms
These Terms govern every product or service that links to them (together, the “Services”), including:
- Rad Games titles, including the Puppies vs. Kittens series (Puppies vs. Kittens - Zoomies, Puppies vs. Kittens - Hide & Squeak, Puppies vs. Kittens - Paw of Cards, Puppies vs. Kittens - Litter Squad) and the RiftBleed series (Hollowshot, Deepfrost, Killwall, Silent Echo, Broken Glass), together with their updates, downloadable content and online features;
- Our websites, including radgames.ai and janusengine.com;
- Janus Studio, our browser-based creation tools, including Game Genie and the asset library;
- the Janus Arcade, where people publish and play games made with Janus;
- the Janus API and MCP server, which let your own software and AI agents use Janus Studio tools; and
- supporting services such as accounts, guest sessions, payments, player support and community features.
Some Services have extra terms that apply on top of these Terms. The most important are the Janus Studio & Credits Terms, which cover AI generation, credits, the Arcade and the API. If extra terms conflict with these Terms, the extra terms win for that Service.
The Janus Engine itself (the engine runtime, editor and SDKs you download to build games) is governed by the separate Janus Engine License, not by these Terms, except where that license says otherwise.
2.Accounts and guest sessions
You can try parts of Janus Studio without an account. When you do, we create a guest session tied to a cookie in your browser. Guest credits and files belong to that browser session; if you clear your cookies or switch browsers before signing up, we may not be able to recover them. When you sign up, we move your guest credits and files into your new account.
Some features, such as publishing to the Arcade, buying credits or creating API keys, require an account. When you create one, you agree to:
- give accurate information and keep it up to date;
- meet the age requirements in Section 3;
- keep your password and API keys secret and tell us promptly at legal@radgames.ai if you think someone has accessed your account without permission;
- use only your own account, and not sell, rent, lend, trade or share it; and
- accept responsibility for everything that happens under your account, including actions taken by software or AI agents you connect to it.
Your display name is public. We may change or remove a display name that is offensive, misleading, impersonates someone or infringes someone else’s rights.
You can delete your account at any time from your account settings or by contacting us. Deleting an account is permanent: purchased items, unused credits and saved files tied to it will be lost, so please download anything you want to keep first.
3.Age requirements and young players
Different Services have different minimum ages:
- Puppies vs. Kittens games are made for a general audience that includes children. Where a player is a child under the age set by local law (13 in the United States), we apply the protections described in our Privacy Policy, including verifiable parental consent where the law requires it.
- RiftBleed games are made for mature players and carry the age rating shown on their store page. They are not directed to children.
- Janus Studio, the Arcade (for publishing) and the Janus API are for people aged 13 or older, or 16 or older in countries of the European Economic Area where local law sets that age for consenting to online services.
If you are under 18, you may use the Services only with the involvement of a parent or guardian, who must agree to these Terms. Real-money purchases must be made by an adult or with an adult’s permission (see Section 7).
4.Your license to use the Services
Our games, tools, websites and digital items are licensed to you, not sold. Subject to these Terms, IDFire grants you a personal, limited, non-exclusive, non-transferable, non-sublicensable and revocable license to access and use the Services for your own personal, non-commercial entertainment, or, for Janus Studio and the API, for the creative and commercial purposes the Janus Studio & Credits Terms allow.
Unless these Terms or another written agreement with us allows it, you may not:
- copy, sell, rent, lease, sublicense or otherwise commercially exploit the Services or any part of them;
- reverse engineer, decompile, disassemble or create derivative works of our software, except to the extent the law expressly allows despite this restriction;
- remove, hide or alter copyright, trademark or other notices, or AI-provenance markings we attach to content;
- scrape, crawl or harvest data from the Services, or access them by automated means other than our published API;
- use our games, art, audio, characters or other content (as opposed to your own outputs) to train, fine-tune or evaluate any artificial-intelligence or machine-learning model;
- interfere with, overload or try to gain unauthorized access to the Services, other users’ accounts, or our systems; or
- use the Services in a way that breaks the law or infringes anyone’s rights.
We and our licensors keep all rights not expressly granted to you. Puppies vs. Kittens, RiftBleed, Rad Games, Janus Engine and related names and logos are trademarks of IDFire Technologies Inc. and its affiliates; nothing in these Terms gives you the right to use them, except as our Fan Content Policy allows.
5.Fair play and game integrity
Our games should be fun and fair for everyone. You agree not to:
- use, make, sell or promote cheats, hacks, bots, macros or other unauthorized software that gives an advantage or automates play;
- exploit bugs or glitches, or encourage others to do so (if you find one, please report it to us instead);
- tamper with, disable or work around anti-cheat, anti-fraud or security systems;
- manipulate leaderboards, rankings, matchmaking or asynchronous “ghost” team results; or
- buy, sell or trade accounts, items or currencies outside of features we provide for that purpose.
We use automated and manual tools to detect cheating and fraud. We don’t publish exactly how those tools work, because that would help people defeat them. If we find cheating or fraud, we may reset progress, remove items obtained improperly, or suspend or close accounts. You can appeal by writing to legal@radgames.ai.
6.Changes to these Terms and to the Services
We may update these Terms from time to time. If a change is material, we will tell you in advance (by email, in the product or on this page) and say when it takes effect. If you keep using the Services after an update takes effect, you accept the updated Terms. If you don’t agree with a change, you can stop using the Services and close your account.
Games and online services evolve. We may add, change, rebalance or remove features, content, tools, models or prices, and we may need updates to be installed for the Services to keep working. If we discontinue a paid Service entirely, Section 15 explains what happens.
7.Purchases and payment
Real-money purchases must be made by an adult (18 or the age of majority where you live) who has the right to use the payment method, or with that adult’s permission. Parents can use the parental controls on their device or app store (such as purchase approval) to manage what a child can buy.
When you buy directly from us, payments are processed by our payment provider, Stripe. You agree to pay the price shown at checkout plus any applicable taxes, and you authorize us and Stripe to charge your payment method. We do not store your full card number. Prices may change, but a change never affects a purchase you have already completed.
If you buy one of our games or items through a third-party store, such as Steam, the Apple App Store or Google Play, that store processes your payment and its terms (including its refund rules) apply to that transaction. These Terms still apply to your use of our game.
8.Refunds
Our Refund Policy explains which purchases you can refund and how. Nothing in these Terms limits any refund or withdrawal right you have under the consumer law of the country where you live.
9.Virtual items, in-game currency and credits
Some Services offer virtual items, such as cosmetics, cards, in-game currencies, unlocks and Janus Studio credits (together, “Virtual Items”). You can earn some Virtual Items through play and buy others.
Virtual Items are a limited license to use digital content inside the Services. They have no cash value, are not your property, cannot be exchanged for real money or for anything outside the Services, and cannot be sold, transferred or traded except through features we provide.
We may correct balances that are wrong because of a mistake or a technical error, and we may remove Virtual Items obtained through cheating, fraud, chargeback abuse or other violations of these Terms. We may change how Virtual Items work as the Services evolve, but we will not reduce the value of paid Virtual Items you already hold without good reason, and where the law requires it we will give you notice or a refund.
Janus Studio credits have extra rules (for example, they never expire, and failed generations are refunded automatically). See the Janus Studio & Credits Terms.
If any of our games offers a paid item with a random outcome, we show the odds before you buy it.
10.Community Rules and reporting
Everyone who uses the Services must follow our Community Rules. They apply to chat, display names, everything you create and publish (including Arcade games and AI-generated content), and how you treat other players.
You can report a person, a game or a piece of content using the in-product report tools or by emailing legal@radgames.ai. You can also block or mute other players where the feature is available.
When we learn of a violation, we decide what to do based on how serious it is, whether it has happened before and its effect on others. Actions range from a warning or content removal to temporary restrictions or permanent account closure. Where the law requires, we will tell you what we did and why, and how to appeal. In the most serious cases (such as threats to a child’s safety), we may report the matter to law enforcement or to the National Center for Missing & Exploited Children.
11.Your content
“Your Content” means anything you upload, write, record, prompt or create in the Services, including prompts, uploads, generated assets, games you publish to the Arcade, display names and messages.
You keep ownership of Your Content. To run the Services, you grant IDFire and its affiliates a worldwide, non-exclusive, royalty-free license to host, store, copy, process, display, adapt (for example, to make thumbnails or resize images) and transmit Your Content, for the purpose of operating, securing and improving the Services and providing them to you and, for content you make public, to other users. This license ends when you delete Your Content or your account, except where the content has been shared with others, is needed to meet a legal obligation, or remains for a limited time in backups.
When you publish a game to the Arcade, the broader license in the Janus Studio & Credits Terms also applies, so other people can play it and remix it.
You promise that you have the rights needed to share Your Content and to grant these licenses, and that Your Content follows these Terms and the Community Rules. We do not pre-screen everything, but we may remove or restrict any content that we believe breaks these Terms or the law. AI-generated content is covered by the Janus Studio & Credits Terms.
12.Fan content
We love seeing what our community makes. Our Fan Content Policy explains how you can create and share fan art, videos, streams and other content based on our games outside the Services.
13.Feedback and ideas
If you send us feedback, suggestions or ideas about the Services, you allow us to use them for any purpose without paying you or crediting you, and without any duty of confidentiality. Please don’t send us unsolicited game designs, stories or art; we don’t review them, so that no one can later claim we used their idea.
14.Third-party services
The Services may link to or work with services run by others, such as app stores, payment providers, streaming platforms and AI model providers. We are not responsible for those services, and your use of them may be governed by their own terms and privacy policies.
15.Termination
By you
You can stop using the Services at any time and end these Terms by deleting your account. If you use a Service without an account, you end these Terms for that Service by no longer using it.
By us
We may suspend or terminate your access to some or all of the Services if you seriously or repeatedly break these Terms, if we must do so to comply with the law, or if your use creates a risk or legal exposure for us or other users. Where reasonable, we will tell you beforehand and give you a chance to fix the problem. You may not create a new account to get around a suspension or ban.
We may also discontinue a game or Service, or stop offering it on a particular platform, for business, technical or legal reasons. When we do, we will give at least 30 days’ notice where practical. If we permanently shut down Janus Studio, we will refund the unused balance of credits you bought; for games, we will follow the refund requirements of applicable law.
What happens next
When these Terms end, your license to use the affected Services ends, and you may lose access to Virtual Items, credits, progress and content tied to your account. Except as stated above or required by law, termination does not entitle you to a refund. Sections that by their nature should survive (including Sections 4, 9, 11, 13 and 16 through 23) continue to apply.
16.Disclaimers
To the fullest extent permitted by law, the Services, Virtual Items and all content and outputs are provided “as is” and “as available”. IDFire, its affiliates, licensors and service providers make no warranties of any kind, express or implied, including implied warranties of merchantability, non-infringement, title, fitness for a particular purpose, accuracy, or that the Services will be uninterrupted, secure or error-free.
Some online features need an internet connection, which you provide at your own cost. Some countries do not allow certain warranties to be excluded; in those places, the exclusions above apply only as far as the law allows.
17.Limitation of liability
To the fullest extent permitted by law, IDFire and its affiliates, licensors and service providers will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, goodwill or Virtual Items, arising out of or relating to these Terms or the Services. Our total liability for all claims relating to the Services is limited to the greater of (a) the amount you paid us for the Services in the 12 months before the claim arose and (b) US$100.
If you live in the European Union or the United Kingdom: nothing in these Terms limits our liability for death or personal injury caused by our negligence, for fraud, for gross negligence or willful misconduct, or for any other liability that cannot be limited by law. We are responsible for foreseeable loss caused by our breach of these Terms, and you keep your statutory rights for digital content that is faulty or not as described.
18.Indemnity
To the extent the law allows, you agree to defend and compensate IDFire and its affiliates, officers, employees and agents against third-party claims, and the related losses and reasonable legal costs, that arise from Your Content, your misuse of the Services or your violation of these Terms or of anyone’s rights. This section does not apply to consumers where local law does not permit it.
19.Governing law and venue
These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws rules, and, where applicable, the US Federal Arbitration Act. Any dispute that is not subject to arbitration under Section 20 will be heard only in the state or federal courts located in Delaware, and you and we consent to their jurisdiction.
If you are a consumer living outside the United States, you also benefit from any mandatory protections of the law of the country where you live, and you may bring proceedings in your local courts where that law gives you the right to do so.
20.Dispute resolution and arbitration (United States)
Please read this section carefully. If you live in the United States, it requires most disputes to be resolved by binding individual arbitration instead of in court, and it waives your right to take part in a class action. You can opt out within 30 days, as described below.
Talk to us first
Before starting a formal dispute, send a written description of the problem and the outcome you want to legal@radgames.ai. We will try in good faith to resolve it with you within 60 days.
Binding individual arbitration
If we cannot resolve the dispute informally, you and IDFire agree to resolve any claim relating to these Terms or the Services through final, binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration may take place by video, by written submissions, or in the county where you live. For claims within its limits, IDFire will pay the filing, administrative and arbitrator fees beyond what you would pay to file in court.
No class actions
You and IDFire may bring claims against each other only in an individual capacity, not as a plaintiff or class member in any class, collective or representative proceeding, and an arbitrator may not consolidate claims of different people.
Exceptions
Either party may bring an individual claim in small-claims court, and either party may ask a court to stop the infringement or misuse of intellectual property.
Your right to opt out
You can opt out of arbitration (but not the class-action waiver) by emailing legal@radgames.ai within 30 days of first accepting these Terms, with your name, account email and a clear statement that you are opting out of arbitration. Opting out does not affect any other part of these Terms.
This section does not apply to consumers in the European Union, the United Kingdom or any other place where pre-dispute arbitration agreements with consumers are not enforceable. EU consumers can also use the out-of-court dispute settlement bodies available under local law.
21.Copyright and intellectual-property complaints
We respect the rights of creators and expect our users to do the same. If you believe content in the Services infringes your copyright or other rights, follow the process on our Copyright & DMCA page. We close the accounts of repeat infringers in appropriate circumstances.
22.General terms
- Entire agreement. These Terms, together with the documents they link to, are the whole agreement between you and us about the Services.
- Severability. If any part of these Terms is found unenforceable, the rest stays in effect, and the unenforceable part is modified only as much as needed to make it enforceable.
- No waiver. If we don’t enforce a provision right away, we don’t give up our right to enforce it later.
- Assignment. You may not transfer your rights under these Terms. We may transfer ours to an affiliate or to a successor in a merger, acquisition or sale of assets.
- Events beyond our control. We are not responsible for delays or failures caused by events outside our reasonable control, such as outages at our providers, natural disasters or changes in law.
- Export controls. You may not use the Services if you are located in, or are a resident of, a country or region subject to comprehensive US sanctions, or if you are on a US government restricted-party list.
- Notices. We may send you legal notices by email to the address on your account or through the Services.
- Language. These Terms are written in English. Any translation is for convenience only, and the English version controls to the extent the law allows.
23.Platform-specific terms
Apple App Store
If you downloaded one of our apps from the Apple App Store: these Terms are between you and IDFire, not Apple, and IDFire (not Apple) is responsible for the app and its content. Apple has no obligation to provide maintenance or support for the app. If the app fails to meet any applicable warranty, you may notify Apple, and Apple may refund the purchase price you paid for the app; Apple has no other warranty obligation to the extent the law allows. IDFire, not Apple, is responsible for addressing any claims relating to the app, including product-liability claims, claims that the app fails to meet legal or regulatory requirements, consumer-protection claims and claims that the app infringes someone’s intellectual property. You confirm that you are not located in a country subject to a US government embargo and are not on a US government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
Google Play, Steam and consoles
If you get our games from Google Play, Steam or another platform, that platform’s terms of service also apply to your use of the platform, and its rules govern purchases you make through it.
